Introduction
In a construction project, the Conditions of Contract plays a pivotal role in governing the rights and obligations of the contracting parties, i.e. the Employer and the Contractor. The Engineer, as the agent of the Employer, has to carry out his duties in accordance with the Conditions of Contract. On the other hand, contractors often look into the Conditions of Contract to look for their rights and obligations. Disputes often arise during the interpretation of clauses in the Conditions of Contract; which, as a matter of fact, is challenging as the clauses are not written in plain English.
Over the years, there have been various literatures and case laws covering the interpretation of the difficult clauses in the Conditions of Contract. This course will equip participants with the essential knowledge so they have a thorough understanding on where they stand when issues are in dispute.
Course Objectives
Upon completion of this seminar, participants will be able to:
- Understand the operation of the Government Conditions of Contract
- Interpret the more difficult clauses in the Conditions of Contract
- Grasp the rights and obligations of the contracting parties
- Avoid the loopholes of falling into difficult situations due to misunderstanding of the Conditions
- Improve the project management skill especially in terms of dispute resolution
