The Belt and Road Initiative unveiled in 2013 aims to strengthen regional connectivity through a range of projects in infrastructure investment, including railway and highway, real estate, construction materials, automobile and education etc. On the one hand, the Initiative represents vast amount of opportunities for Hong Kong professionals and enterprises. On the other hand, given the nature and diversity of the projects, it presents challenges to the local professionals and enterprises, particularly in the assessment of projects at the feasibility stage.

Objectives

In this workshop, the speakers addressed the challenges and helped participants to gain a better understanding of how to conduct feasibility study on the Belt and Road projects. The following topics were covered:

  • Project valuation techniques;
  • International project valuation standards;
  • Economic appraisal: theory and methods; and
  • Financial appraisal and development decisions.

Prof. Hui is an all-round professional with diverse experience in both local and international research and consultancy projects. In 2015, Prof. Hui received a medal of honour from the Hong Kong SAR Government to recognize his outstanding contributions to the society, especially on Town Planning Board and the surveying sector.

His latest research projects focus on the analysis of real estate markets and urban development in Hong Kong and Greater China.

A well-respected quantity surveyor, Mr. Stephen Yuk-fai Lai is a member of Rider Levett Bucknall’s global board and managing director overseeing Hong Kong, China and Korea offices.

Mr. Lai joined the firm in 1989 and built his reputation as a trusted Cost and Contract Management Consultant. For more than 30 years, he has developed creative project delivery strategies for clients throughout Asia and the Middle East. Externally, he has become a trusted thought leader on state of the construction industry and future trends in construction project management.

Mr. Lai is a Fellow of the Royal Institution of Chartered Surveyors, a Fellow of the Hong Kong Institute of Surveyors, and a Fellow Member of the China Engineering Cost Association. He is the Past President of the Hong Kong Institute of Surveyors. Currently, he is the Chairman of the Mainland Affairs Committee of the Hong Kong Institute of Surveyors, Board Member of the Construction Industry Council and Chairperson of the Committee on Construction Procurement, Member of the Start-up Loan for Post-secondary Education Providers Vetting Committee; Member of the Appeal Tribunal Panel; Member of the Working Group on Professional Services for Economic Development Commission; Board Member of Zero Carbon Building; Member of Provision of Space in the Legal Hub committee; Member of the Corruption Prevention Advisory Committee of the Independent Commission Against Corruption; Member of the National Committee of the Chinese People’s Political Consultative Conference (CPPCC) of Xuhui District, Shanghai.

Dr. Qu Jian’s main research areas include planning of domestic and foreign special economic zones, technological innovation and planning of high-tech industries, industrial transformation and upgrading. In recent years, as the head of the Chinese expert delegation, he and his team provide support to the planning and development for special economic zones and industrial parks of more than 10 Asian and African countries, including Pakistan, Sri Lanka, Ethiopia, Kenya, Congo (Brazzaville), Côte d’Ivoire, etc.

The national and local research projects of Dr. Qu Jian and his team include the National Twelfth Five-Year Development Plan for National Economic and Technological Development Zones and Border Economic Cooperation Zones, the National Innovative Urban Construction Plan, the Strategic Study of China’s Processing Trade Transformation and Upgrading, Research on the Development Model of China’s Development Zones and Customs Special Supervision Zones, China’s Yellow River Delta Efficient Ecological Economic Development Plan, New Features, New Trends and Measures of Multinational Corporations’ Investment in China, Research on Strategy of China’s Processing Trade Transformation and Upgrade, etc. Besides, Dr. Qu and his team provide study on the development strategy and planning of special economic zones and industrial parks in many countries.

In the project life cycle, quantity surveying (QS) consultancy is often engaged as early as in the feasibility study stage. Developers rely on the expertise of QS to appraise and forecast the economic feasibility of a project from the outset, setting out a control framework for the entire construction process.  

Levering the advantages of Hong Kong as a “super connector” in “Belt and Road” projects, RLB has provided full quantity surveying services to a number of clients in the Mainland of China and Hong Kong for their overseas projects. 

As a well-respected quantity surveyor and construction cost estimator, Dr. Stephen Lai will brief us the internationally-accepted construction contracts, and how to mitigate risks through feasibility study. He will also share some case studies to showcase RLB’s project experiences in Cambodia, Korea, Russia and Australia.

China Development Institute (CDI) is one of the 25 China Top Think Tanks Construction Pilot Units. It possesses Grade A engineering consulting qualification and has been committing to planning and research on special economic zones and industrial parks.

Dr. Qu in recent years has led the Regional Development Strategies and Planning Center of CDI to “go out” to undertake some overseas park planning projects. He has accumulated experience in consulting services in the construction of special economic zones and industrial parks in Asia and some African countries.

Ethiopia, Congo in Africa and Pakistan in Asia are all countries along Belt and Road. Dr. Qu will share the economies of the development parks in these countries. He will also discuss the issues of project appraisal and management of overseas industrial parks through some cases of study projects on investment feasibility. The discussion topics include challenges and approaches to managing overseas projects.

One of the Belt and Road Initiative focal points is to ensure the financeability of projects with smooth two-way cash flow. To achieve this, the financial operation between China and the Belt and Road countries should be enhanced, besides securing initial fund injection to kick start the infrastructure projects.

Much reliance has to be placed on using the appropriate financing instruments, assistance of multi-lateral institutions and capacity-building of financial entities in the countries concerned. Being a regional financial centre, Hong Kong can play an important role in making these happen.

Objectives

  • Modern portfolio theories: the basics of classical investment theories;
  • Other theories used to estimate the risk and return of investment assets, whether financial or real, and to construct a portfolio of assets that offers the highest expected risk-adjusted return; and
  • The methodology of making investment decisions, which are always a trade-off between risk and return;
  • The principles of cross border financing of infrastructure works and the implications on practice.

Mr. Joseph Chan Nap-kee, has over 30 years of experience in commercial and investment banking and asset management as well as more than a decade of operation and investment experience in the Belt and Road. Thomas Leung is the Deputy Markets Leader and South China Markets Leader, as well as a member of the Management Board of PwC China/HK.  He is also a member of the Management Board of PricewaterhouseCoopers Zhongtian LLP. Thomas was the China North Assurance Leader of PricewaterhouseCoopers Zhong Tian LLP and led the Assurance business of PwC China in Beijing, Tianjin, Qingdao, Dalian, Shenyang and Jinan. Thomas was also the leaders of PwC China Transportation and Logistics Industry Group as well as Engineering and Construction Industry Group.

Having been with the Firm for 29 years and 19 years as a partner, Thomas has worked in Hong Kong, Winnipeg, Vancouver and Beijing. His focus in the last decade has been on serving many of the major state-owned enterprises in China on their audit, restructuring, IPO and outbound investment engagements. 

Some of his key clients include: CITIC Limited, China Post Group, China Communications Construction Company Limited, Legend Holdings Corporation, NetEase.com, Inc., Xiaomi Technology, Beijing Organising Committee for the 2022 Olympic and Paralympic Winter Games and etc.

Christopher is PricewaterhouseCoopers partner based in Beijing leading the Northern China practices of Corporate Finance and Capital Projects & Infrastructure.  He is responsible for domestic and overseas, fund raising, asset divestiture, merger and acquisitions, as well as domestic and international greenfield and brownfield projects.  Over the last few years, Christopher has been involved in a number of Belt and Road projects from port, toll road, power plants, industrial park to manufactures in the regions including Southeast Asia, South Asia, Eastern Europe and Africa.

He had spent 7 years with PricewaterhouseCoopers Hong Kong and Beijing before he worked for HSBC Private Equity as a senior manager where he was responsible for direct investment projects in greater China, Southeast Asia and South Korea. After that, Chris joined Tom Group, a HK-listed media Group as vice general manager for 5 years.  He re-joined PwC Beijing office in June 2005.

Christopher mainly focuses in the industries of infrastructure, energy, FS, FMCG, TMT and healthcare.  His clients include a large number of MNCs, SoEs and domestic private enterprises. He was awarded the best M&A Financial Adviser by China Merger and Acquisition Association in 2013.

They will share how infrastructure projects are evaluated at feasibility stage, including how financial modelling are set up taking consideration project risks to evaluate returns for informed investment decision making; the contractual arrangements used for risk control / mitigation under PPP framework to minimise project risks to an appropriate level in order to achieve financial close; as well as the various financing structure for infrastructure projects and source of financing.

Ms. Wang has participated in a wide range of projects, including the China-Belarus Industrial Park and Thar Engro Coal Power Project in Pakistan. She was involved in the investment and financing of these projects and during the workshop, she will share her experience and the challenges she faced.

Ms. Wang will also share the preferential policies offered by The PRC government and financial institutions for developing energy projects in Pakistan, which helped pave a strong financial foundation. Insured by SINOSURE (China Export & Credit Insurance Corporation), over US$800 million was financed by China Development Bank, together with China Construction Bank and ICBC on this particular project.

 

Professionals tend to view project risks from the perspective of their own professions. They also tend to be more familiar with the types of risks that they often encounter in their practices and have a unique set of technical jargons and tool kits in dealing with such risks.

As a result, years of learning and experience are often required to enable cross-professional communication on risk management issues while at the same time, emerging risks (or opportunities) which do not traditionally belong to a professional domain are often overlooked.

Prior to joining PolyU, Dr. Zhang was affiliated with Nanyang Technological University. He is an Associate of the Society of Actuaries and has served on the Board of Directors of the Asian Finance Association since 2010.

Dr. Zhang has given lectures at universities in the United States, Mainland China, Singapore and Hong Kong and received the PolyU Faculty of Business’s Prize for Outstanding Performance in Teaching in 2016. His main research interest is to understand the price formation process in financial markets. His research papers have been published in leading academic journals and have received multiple best paper awards.

Han Chen is a Senior Vice President of Guy Carpenter based in Hong Kong. He is responsible for Taiwan and Japan actuarial work, as well as cyber research for APAC region. Han is a fellow of SOA and an associate of CAS.

Han has published several papers on US actuarial magazines. He is a recipient of CAS 2012 Ronald Bornhuetter Loss Reserve Prize, and 2015 CAS Variance Best Paper Prize. Han is a frequent speaker at various conferences, including actuarial associations and US Federal Reserve.

Han holds a dual Master degree in actuarial science and risk management from Georgia State University, and a Bachelor degree in mathematics from Fudan University.

Pat is a Partner of Business Reporting and Sustainability at KPMG who oversees Corporate Social Responsibility as well as being a core member of the KPMG China Steering Committee on Climate Change & Sustainability (“CC&S”).  He is also a member of the KPMG Global CC&S network.

He has been active for over 10 years in the field of sustainable development.  In his previous capacity as a director at Central Textiles, through his leadership Central Textiles was the first textile company in Asia to issue a Sustainability Report under the Global Reporting Initiatives (“GRI”) Guidelines in 2008. The report subsequently received an award from the Association of Chartered Certified Accountants (“ACCA”).

Through his initiatives Central Textiles subsequently won the Gold Award for the Hang Seng Pearl River Delta Environmental Award in 2012 and the Hong Kong Award for Environmental Excellence (“HKAEE”) – Manufacturing Sector in 2013.  He also helped KPMG win the HKAEE Silver Award – Service and Trading Sector in 2017.

For his contribution to the textile industry with regards to sustainability, Pat received the Young Industrialist of the Year award from the Federation of Hong Kong Industries in 2009.

Dr. M W Chan is currently Professor of Practice of PolyU with 40 years working experience in the academia and industry both locally and overseas.  His main research interest is in cross cultural management of major program.  

Professionally, he is a Chartered Surveyor, Project Manager, Professional Facility Manager as well as an Authorized Person (Surveyor) of the Building Authority of HKSARG.  He was formerly the Executive Director (Project Delivery) of the West Kowloon Cultural District Authority (WKCDA).  Prior to joining WKCDA he was the Vice President (Projects & Facilities) of the Hong Kong Science and Technology Parks Corporation (HKSTP).  He had worked in the private sector and was Partner of Vigers HK Chartered Surveyors in 1980s.  He had also worked many years in North America in construction and real estate.

Academically, he holds a BSc in Building Surveying, MSc in Construction Project Management, MIPA in International & Public Affairs and a PhD. Recently, he studied at the Oxford University (St. Catherine College) and obtained the MSc (MPM) in Major Program Management. 

He is the Founding President of the Hong Kong Institute of Facility Management (HKIFM) and was the Chairman of the Project Management Committee of the Hong Kong Institute of Surveyors (HKIS).  He was also member of the Building Tribunal, HKSARG and an Adjunct Professor of the University of Hong Kong.

Gilbert is a partner of Clyde & Co's China Construction Group. Before he started his legal work in 1991, he had been a qualified quantity surveyor in the construction industry. He is experienced in drafting and advising on construction contracts, consultancy agreements and other related contracts relating to a wide range of infrastructure projects in a number of countries and cities, such as Hong Kong, Beijing, Shanghai, Macau, Korea, Bolivia, Ecuador, Soviet Union and Angola. In addition, he is also a construction disputes specialist. He has successfully handled numerous arbitration and litigation cases for 28 years.

Gilbert is recognized as a leading lawyer for construction (Hong Kong and China) in Chambers Asia Pacific since 2012.

He is also a Fellow, Hong Kong Institute of Surveyors (HKIS) and Past Chairman, the Quantity Surveying Division of HKIS.

Senior Engineer, with Bachelor Degree in Mechanical Engineering and Master Degree in Business Management and Administration, with 35 years experiences in Electrical Power areas in which about 12 years experiences in power generation and transmission project construction, more than 20 years in the management of planning, procurement, engineering and international business.

He has rich practical experience and outstanding achievements in power project construction, operation, project investment and financing, international project management, and cross-cultural management. Since 2014 he works in State Grid Brazil Holding SA and is responsible for the development and construction of Greenfield project. Mr. Chang Zhongjiao will introduce the investment and operation of State Grid Brazil Holding in Brazil, mainly focusing on the construction of greenfield projects, especially the UHV DC transmission project for Belo Monte hydropower station.

While realising the “going global” of UHV DC technology, investment, construction, and operation, The Bipole I and Bipole II projects are also important examples of the “One Belt, One Road” initiative and international industrial capacity cooperation. The speaker will share the successful cases and practices which the Project Management team adopted, including overcoming the challenges of Brazil's strict environmental laws and regulations, complex processes, trickiness of managing local coordination and cultural differences.

 

Belt and Road infrastructure projects usually involve with at least one of the key players (e.g. contractor, consultants or employers) working outside its country of origin. As these multi-national participants come from different political, legal, economic, and cultural backgrounds, disputes in these projects involve more than just rights and interests of the parties. If disputes are not managed properly, they tend to cause project delays and destroy business relationships.

Since globalization lead us to harmonization and convergence with international practice, international projects call for common practices and procedures and have led to something approaching a ’global law’.

Prof. Chan studied Architecture and later learnt Law in England and Hong Kong. He obtained his PhD degree at King’s College of London University. He is qualified as a Chartered Architect, Engineer and Surveyor and a Barrister-at-Law. He is Professor & Programme Leader of the MSc in Construction Law and Associate Head (Research 2007-2017) of Department of Building and Real Estate, and has been appointed as Adjunct Professor of other universities including University of South Australia and Sun yat-sen University and Hunan University in China etc., . He is an accredited mediator of the Hong Kong International Arbitration Centre and a mediator/arbitrator of the Joint Panel of Mediators/Arbitrators of the Hong Kong Institute of Surveyors (HKIS) and Hong Kong Institute of Architects (HKIA). Panel arbitrator of the Guangzhou Arbitration Commission. He is the chairman of the HKIA’s Contract and Dispute Resolution Committee (2005-2009).

He has carried out a wide range of research relating to urban development including: Sustainability policy for urban environment; Urban renewal/ heritage conservation; Low carbon polices; Healthy/Green building; Institutional analysis and transaction costs for “Green” promotions; Dispute management; and Community issues. He has published his work in about 130 international SCI/SSCI journal papers and many book chapters. He serves as an editor or editorial board member of several research journals and has edited many books related to his research.

Mr. Daniel C. Lam, SBS, JP
Chief Executive Officer, eBRAM Centre Limited

Mr. Lam is a practicing arbitrator and an experienced property development and construction expert, specialized on property developments above railway stations and depots, hospitals and urban redevelopments.  He is currently the Chief Executive Officer of eBRAM Centre Limited.

He is a Chartered Arbitrator and listed on the panels of Hong Kong, London and Vancouver, and is appointed as Arbitrator to CIETAC and the Beijing Arbitration Commission (1998-2012).  He is also a member of the South China International Economic and Trade Arbitration Commission (2012-present), and a member of the International Council of Commercial Arbitration in Hague.  In 2016 he was also appointed as arbitrator by the One Belt One Road (China) Arbitration Court.  He is a Past President of the Hong Kong Institute of Surveyors (1986-1987) and the Founding and Past Chairman of the Hong Kong Institute of Arbitrators (1997-2000).  He is a Council member of the Hong Kong International Arbitration Centre (1993-2016), and Chairman of its Mediators Accreditation Committee (2002-2006).  He was the External Examiner of HKU’s Real Estate & Construction Department from 1995 to 1998, and has been appointed as its Honorary Professor for the terms of 2006-2014.

Mr. LEE Kar Chung, Felix is an Executive Director of UMP Healthcare Holdings (722:HK). He is responsible for corporate development, international operations and merger and acquisitions. He is also a Senior Vice President of Chow Tai Fook Enterprises Limited, with responsibilities in making investments in the healthcare sector in Asia and globally. Mr. Lee is also an Independent Non-executive Director of China Resources Medical (1515:HK). Mr. Lee has extensive experience in law, finance and the healthcare industry. Prior to his current roles, Mr. Lee was a solicitor at Freshfields Bruckhaus Deringer, an Analyst in the investment banking department UBS AG, Hong Kong Branch and a Director in the investment banking department of Deutsche Bank AG, Hong Kong Branch.

Mr. Lee obtained a Bachelor of Laws from the London School of Economics and Political Sciences. He has been a solicitor of the High Court of Hong Kong since 2007. Felix is also a member of the China Committee and the Greater Bay Area Committee, the Hong Kong General Chamber of Commerce.

Mr. Lee, graduated from The University of Hong Kong with a Bachelor of Arts (Architectural Studies) degree in 1980 and a Bachelor of Building degree in 1982. He is a Registered Professional Surveyor (QS) with fellow membership of the Royal Institution of Chartered Surveyors and The Hong Kong Institute of Surveyors and membership of the Chartered Institute of Arbitrators. He is on the List of Arbitrators of Hong Kong International Arbitration Centre and is a member of the Joint Panel of Arbitrators of The Hong Kong Institute of Surveyors and The Hong Kong Institute of Architects. Mr. Lee has 38 years’ experience in quantity surveying and commercial management in Hong Kong, the Mainland China, Taiwan, Macau, Singapore and Malaysia. He worked with Asia Allied Infrastructure Holdings Limited (formerly known as Chun Wo Development Holdings Limited [The Group] from 1998 to 2005 and re-joined the Group in 2011. Mr. Lee is a Director (Legal and Commercial) of the Group. He is also currently the Chief Executive Officer of the construction segment Chun Wo Construction Holdings Company Limited of the Group, responsible for the management of the overall construction business of the Group.

Ben has worked for or against corporations or on projects connected to almost every country in Asia-Pacific including China, Hong Kong, South Korea, Japan, India, Bangladesh, Thailand, Vietnam, Malaysia, Indonesia, the Philippines, Singapore, and Australia.

He has acted as counsel on arbitrations seated in numerous jurisdictions and subject to the institutional rules of the ICC, SIAC, HKIAC, LCIA, and LMAA, as well as ad hoc arbitrations subject to the UNCITRAL rules.

Highly respected by clients, he is praised as being an "Arbitration specialist" and "‘very, very smart, with a strategic mind and huge knowledge of international construction" in the Legal 500 Asia Pacific guide 2019.

Ben is qualified in England & Wales and Hong Kong; and has been granted full registration as a Registered Foreign Lawyer in the Singapore International Commercial Court. He is also the Assistant Secretary and International Liaison Officer for the Society of Construction Law Hong Kong.

Ben Bury, Partner of HFW Law Firm, will give an overview of his research into the potential for construction disputes to arise along the Belt and Road. Given the fact that Belt and Road projects are the subject of separate contracts governed by different laws and subject to different arbitration agreements, Ben will discuss the important procedural issue of consolidation of arbitrations.

 

This workshop is designed to serve as the Capstone of the Belt and Road Cross-Professional Advancement Programme workshop series. Through integrated project studies, the total project life cycle from inception, feasibility, funding, design and construction, risk management as well as facility management in relation to OBOR projects will be discussed.

Objectives

The key issues of cross-cultural management and international dispute resolution were simulated. Participants participated in role play and simulation workshops. Challenges of major programme management were also be discussed with special reference to OBOR projects. The following topics were covered:

  • Conceptual review of Program Management, Project Management and Total Facility Management.
  • Public-private partnership (PPP) and selected cases.

Dr. Chan Man Wai

Dr. M W Chan is currently Professor of Practice of PolyU with 40 years working experience in the academia and industry both locally and overseas.  His main research interest is in cross cultural management of major program.  

Professionally, he is a Chartered Surveyor, Project Manager, Professional Facility Manager as well as an Authorized Person (Surveyor) of the Building Authority of HKSARG.  He was formerly the Executive Director (Project Delivery) of the West Kowloon Cultural District Authority (WKCDA).  Prior to joining WKCDA he was the Vice President (Projects & Facilities) of the Hong Kong Science and Technology Parks Corporation (HKSTP).  He had worked in the private sector and was Partner of Vigers HK Chartered Surveyors in 1980s.  He had also worked many years in North America in construction and real estate.

Academically, he holds a BSc in Building Surveying, MSc in Construction Project Management, MIPA in International & Public Affairs and a PhD. Recently, he studied at the Oxford University (St. Catherine College) and obtained the MSc (MPM) in Major Program Management. 

He is the Founding President of the Hong Kong Institute of Facility Management (HKIFM) and was the Chairman of the Project Management Committee of the Hong Kong Institute of Surveyors (HKIS).  He was also member of the Building Tribunal, HKSARG and an Adjunct Professor of the University of Hong Kong.

Walter is Managing Director of TPMA Ltd. He is responsible to lead the business development in Hong Kong, China, Australia and SE Asia. His main specific focus is on pursuit of Public Private Partnerships projects in China and overseas and, merging and acquisitions of engineering consultants in Australia and Singapore. He is also the Chairman of the Institution of Public Private Partnerships in Hong Kong advocating to create a platform for the members to share the PPP knowledge and maximize the PPP opportunities overseas and China.

Formerly, Walter Chan was Project Deputy General Manager with Shenzhen Everbright City Development Co. Ltd. China, responsible for the feasibility study of Shenzhen Metro Line 3 East Extension and the PPP financing solution using Rail and Property model. Prior to this, Walter was the Director of URS Hong Kong in charge of the infrastructure group with responsibility for building, railway, tunnelling, highway, bridge, urban development and water projects.  With 40 years’ experience in managing and designing multi-disciplinary engineering projects, Walter is an expert in managing complex, large scale infrastructure projects in urban development, most notably in Hong Kong but also in Australia and Mainland China. Walter Chan graduated from King’s College London with a BSc in Engineering and Imperial College London with an MSc in Concrete Structures. He also holds an MBA from Deakin University in Australia.
